Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as &#8216;customer&#8217; in this agreement.<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\"><b>Contract creation<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">The placing of an order anywhere on our Site does not constitute a contract. Order acceptance and the contract between you and us will only be formed on the despatch to you of the product(s) ordered unless we have notified you that we do not accept your order, or you have cancelled it. For the avoidance of doubt, a contract is not formed at the point in time that payment has been taken from you by Sippers and Spitters nor at the point when you receive an email from Sippers and Spitters acknowledging receipt of your order.<\/span><\/p>\n<p class=\"p6\"><span class=\"s2\">Non-acceptance of an order may be a result of one of the following:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li7\"><span class=\"s2\">The product(s) you ordered being unavailable from stock<\/span><\/li>\n<li class=\"li7\"><span class=\"s2\">Inability to obtain authorisation for your payment<\/span><\/li>\n<li class=\"li7\"><span class=\"s2\">Our inability to verify that you are aged over 18<\/span><\/li>\n<li class=\"li7\"><span class=\"s2\">The identification of a pricing or product description error<\/span><\/li>\n<li class=\"li7\"><span class=\"s2\">The repeated or fraudulent use of vouchers.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s2\"><b>Rules for Online Conduct<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">By using the service, you agree that you will not attempt to undermine the integrity of this website.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Property Rights<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">All designs, pictures, words, logos and other content contained within this website is the property of Sippers and Spitters or is used by Sippers and Spitters under licence and shall not in any way be copied, reproduced, transmitted or duplicated unless as a means of placing an order with us without the express written permission of Sippers and Spitters. Nothing in these terms shall be deemed to have transferred or consigned any rights concerning such content to any user.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Age Restrictions<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">It is against the law for any person aged under 18 years of age to buy or attempt to buy alcohol and Sippers and Spitters is committed to holding up its legal responsibilities. In purchasing alcohol from us you confirm that you are at least 18 years of age and we reserve the right to perform checks during the purchase process or at point of delivery to ensure you are at least 18 years of age when purchasing alcohol. By placing an order you confirm that you and the recipient of the wine are at least 18 years old. If our couriers are in doubt of the age of the recipient of an order they will request some form of ID. In the event that this is not satisfied they are not permitted to leave the wine.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Delivery<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Our delivery service covers the entire mainland United Kingdom except for the Channel Islands and BFPO addresses.\u00a0We will endeavour to deliver the goods within 2 &#8211; 5 working days during normal working hours on Monday to Friday. If however, this delivery period is not suitable, arrangements can be made for an alternative day or time at extra cost.<br \/>\n<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Independent carriers are used for all deliveries. If you miss the delivery, redelivery can be arranged at your expense. If the delivery has not been successful within 7 days, then the goods will be returned to our warehouse. In the event that we are given instruction to leave wines the risk of damage or loss passes to the purchaser on compliance with the\u00a0specified\u00a0instructions.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Prices<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">There is no minimum purchase.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">All prices are quoted in pounds sterling, and may be per bottle or per case, as marked. The prices include UK duty and VAT, unless otherwise specified. Any delivery charges are additional, unless otherwise specified.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Although we endeavour to ensure that all pricing information on our site is accurate occasionally an error may occur and products may be incorrectly priced. In the event that a product you have ordered is listed at an incorrect price we will contact you by telephone or email before despatching your products asking you to confirm if you still wish to proceed with your order at the correct price or cancel your order. If you do not confirm that you wish to proceed with the order within seven days of the date of our email, we will consider this is a withdrawal of your order.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Where a particular wine is part of a pre-mix case with a general discount applied, the discounted price for the case is relative to the non-discounted prices for the constituent wines.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">We reserve the right to alter prices without notice in the event of major currency fluctuations, changes in the rate of duty, VAT or other taxes, or other market conditions. We also reserve the right to terminate any special offer at any time, without notice.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Availability<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">All products and other items are subject to availability. Occasionally we will substitute wines for those of a different vintage, where these are of equal or greater value. Where a product is out of stock we will make every effort to offer an alternative product or to provide a reasonable estimate of when the product will return to stock.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Mixed Cases<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">We reserve the right to change the contents of any pre-mixed case of wine. In the event that any wine within a pre-mixed case becomes out of stock, we may substitute the wine shown for an alternative of similar or higher value.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Faulty Products<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">We will provide a full refund of any wines that are faulty. This does not affect your statutory rights.<br \/>\nFaulty bottles may be required to be returned to us and we will arrange this as necessary at your convenience.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Breakages<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">If any bottles are damaged or broken the carrier will normally not deliver the case and a replacement case will be despatched, at no additional cost, as soon as possible. We will keep you advised on the status of your order. If a breakage is found after delivery please contact us immediately. Please wherever possible retain the original packing.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Substitutions<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">There may be occasions when one of our wines is temporarily out of stock &#8211; we will offer you an alternative of equal value which you can accept or decline. It is possible that the vintage indicated on the website is no longer available and if this happens we will offer you the vintage which we have in stock. You can accept or decline the replacement vintage or an equivalent value and quality alternative. In either eventuality we will keep you fully informed.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">There are some products on the website which are not vintage specific. For these products you may receive mixed vintages if you have ordered more than one bottle.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Wineries occasionally change the name and\/or labelling of certain wines without notification. Wherever possible we will supply you with the wines as shown on our website but this may not always be possible.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Cancellations and Complaints<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Any order may be cancelled but any cancellation must take place within 14 working days from date of delivery. Should you decide to cancel, all charges to you will be refunded as soon as the goods are returned in merchantable condition.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">In the event of complaint, please contact the company on +44 (0)20 3290 7477, alternatively email customer@sippersandspitters.com giving as much detail of your complaint as possible. All complaints will be acknowledged within 2 working days and we will endeavour to resolve the matter as soon as possible.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Privacy Statement<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Where you have been directed to our site from a third party\u2019s website, we may pass your details back to the introducing firm. You agree that the information we or the third party holds about you can be held on computer and\/or paper files. You agree that any information which you give us may be disclosed to these third parties for the purpose of contacting you from time to time by post, fax, e-mail or telephone to bring to your attention additional products or services the third party may be able to provide.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Re-Sale<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">All items purchased via our website are for personal use and shall not be sold on in any way whatsoever.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Fraud and Crime Prevention<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">We reserve the right to share any information we may collect with the police or other legislative bodies in accordance with relevant legislation for the purposes of detection of offences or the apprehension or prosecution of offenders.<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\"><b>Liability<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">All images used on this website are for illustrative purposes only and whilst every effort is made to ensure accuracy, no liability is assumed by Sippers and Spitters Limited in the event that product colours etc. do not match illustrations. Any product descriptions are made by us for general guidance or by winemakers or other suppliers and whilst all care is taken to ensure accuracy we make no warranties as to this site or its contents and do not accept liability for any alternative views or opinions regarding products contained within this website. Any links contained within this website to alternative websites are made for your convenience and we do not accept any liability or obligation for information contained on other websites. Our liability for any losses incurred by you as a result of us breaching the terms of sale are limited strictly to any losses that are foreseeable and reasonably incurred. We are not liable for any delay or failure to perform our obligations arising from any cause outside of our control, including but not limited to acts of God, governmental acts, wars, fires, floods, adverse weather conditions, industrial action, failure of technology or telecommunications or any failure by any third party to perform its obligations. We are not liable for any loss or damage caused by the customer handling wine or other goods and in particular are not responsible for any breakages or spillages, or damage caused to other property as a result of such. Care should be taken when lifting heavy items such as boxes of wine and care should be taken when handling or opening sparkling wine, which can be volatile due to a build up of gasses. Alcohol should always be consumed in moderation.
